Jefferson School was closed down on April/24/2007 because the MCS received a "positive" swipe test for asbestos! The truth is the Atlantic Testing did only three swipe test and one of the three came back as "POSITIVE" and indicated hazardous asbestos in the occupied grade 3 classroom, room 112! The asbestos found was believed to be the harmful serpentine type of asbestos that comes from TYPE-II Chrysotile-Asbestos like used in many school MCS building materials including the floor tiles in many of the classrooms at Jefferson ! The MCS panicked and researched the law for legal loop holes to avoid having to expose the whole truth to the parents! Thereafter MCS Administration manipulated the testing application and applied the lesser testing under the New York Labor Code, because the employees/teachers fall under that NY guideline per se employees as hired in a work place. The NY labor code testing only addresses the airborne type-I asbestos for industrial standard, and does not impose the needed swipe testing as recommended for the Type-II harmful asbestos! Why were the laws and recommendations under the New York State Department of Health Codes not used, that recommended application of both SWIPE TESTING and AIR TESTING for the safety of the public and guideline recommendations of the Federal EPA to do both "air" and "swipe" testing for public safety?
Yes the MCS cleverly hoodwinked the public! Was it done legally? The answer is maybe yes, under the lesser state protection codes. I have called the EPA, and they were unaware that the swipe testing was not done to protect the children. Please read the Courier Observer headlines dated March, titled "MCS must keep EPA Informed". Was doing only one of the two types of asbestos testing done (no swipe testing done) in the best interest of the children? The answer is absolutely NO!!! I have spoken to the EPA. APPLYING EXTRAPOLATION THE MCS WAS AFRAID OF THE TYPE-II TESTING BECAUSE 1 OUT OF 3 HAD ALREADY COME BACK AS POSITIVE FOR AN ASBESTOS! 1 positive out of 3 test = 33% possible positive, the school was more interested in protecting their MCS image, not the safety of the children!!! More formal complaints are before the EPA now. You as parents, and grandparents, and teachers, all school occupants exposed to the deadly asbestos need to call and complain too!
