PUBLIC BEWARE! Rouge Rookie State Troopers! Happens all the time! After you hear what I have to say below, click on the badge above to see another person that was victimized by a rouge State Trooper !

     Trust the law? History has proven that the quality of law is only as good as the quality of those enforcing it! This is James Farbotnik. Everyone is calling and asking what Happened? On Aug./05/09  the newspapers printed that I received numerous traffic tickets on Aug./04/09 while driving a farm tractor on my way to Tractor Supply in Massena. Tickets,  including charges of driving with my NY license under suspension.  My reply to that is garbage! I do not have a NY driver's license that is under suspension!  The officer mistreated me and assaulted my 10 year old son! My son's mother has a formal complaint pending concerning the assault on our child! My plea to the court was not guilty. I have no intention to prejudice this case prior to court trial, with facts of merit to this case aired publicly prior to trial.  What I will say is that I have done nothing wrong. In  my 38 years of driving I have only had one simple ticket and that was over 10 years ago, nor do I have any unpaid fines!  I have done nothing wrong in anyway to warrant a license suspension! This I will adamantly swear to under oath in a court of law! 

       With retrospect, June/2001, only 5 days after I moved to Massena, I was at a stopped a "stop sign" when a black sports car came speeding down the hwy,  and that car tried to make a turn too fast and hit my new 2000 dodge van. I heard the loud music from the black sports car, and I watched in horror as the car full of teenagers came skidding towards me, the sports car trying to make the turn too fast. I was in my van with me 3 small children and my pregnant wife! My Van was hit! I called in the 911 on my cell phone. When the NY State Trooper arrived, he went over to the black sports car first, no one was hurt, and the NY State trooper then began  a long conversation with the persons and I saw that the officer seemed to know theses persons. Then the officer went over to me,   looked at my out of state license, and my out of state plates, went over to his car for a minute, then came back and handed me a ticket for failure to "yield right of way". I told the officer "what are you talking about  "I am stopped at the stop sign and the other car hit me in the rear of my van 15" behind the stop sign line"! The NY State Trooper (rookie) told me to shut-up and go back to California  where you came  from! I told the officer that I do not live in California, whereupon the officer said "whatever just shut-up and go back to wherever you came from, and if you don't shut-up right now I will arrest you"!   My wife told the officer that this is not right, and got I am going to take picture to show your ticket is a lie, and she got out of the van with  her camera and began taking pictures. The  NY State Trooper (rookie) then tried to physically stop my wife from taking pictures, and I had to intervene, yelling don't touch my pregnant  wife. As this was doing on another NY State Trooper car arrived, and called it into the NY State Trooper Station, and I heard it over the radio to "let them take pictures"! So I began taking pictures too. Lots of pictures and a short video of the accident scene. I hired Massena lawyer Dan Pease. When the matter went to court before Judge Crandall (Judge Crandall is an X-NY State Trooper) and three time for court I was ready with 8x10 glossy pictures showing that my van was hit 15 feet behind the stop sign line, and that I was the victim, but the NY State Trooper failed to show-up every time and also the NY State Troopers failed to supply to the court the written accident report! The ludicrous ticket was dismissed by Judge Crandall. I made a formal complaint to the Massena NY State Trooper Sergeant, but nothing was done, then I complained to the NY State Trooper Major, but nothing was done. Therefore the NY State Trooper (rookie) misconduct and falsified accident report was all cover-up!

     With retrospect, remember in early 2002 when the Village of Massena refused to allow me a business sign  and forced me to take the words "FREE COMPUTERS FOR KIDS AGES 4 yrs.  TO 12 yrs." off of the sign?  Yes,  it was over a year battle with those nasty Village zoning persons. I even hired a lawyer, attorney Eric Gustafson (now known as the Honorable Judge Gustafson) to argue specific law section. The Village Zoning persons turned deaf ears to the law, leaving me two choices. First engage into an expensive Superior Court battle that could take years, or secondly exercise my US Constitution Rights, First Amendment, whereupon under Freedom of Speech law, I posted a  banner that said "FREE COMPUTER FOR KIDS AGES 4 yrs. to 12 yrs" .  Of course the Village Zoning persons tried to stop me from posting the banner but couldn't! So the nasty person next tried to stop me from giving away FREE COMPUTERS to needy Children, yes it was not over and is as is written below! Putting the banner up made the zoning board mad! Then came the problem of 2005 because of my banner!

     With retrospect, do you remember in early 2005 when I was wrongfully charged for running a solid waste facility because I was fixing old computers and giving the computers away for  free to needy children in the community? Yes in early 2005, shortly after I gave away 181 FREE computers systems to needy children in the community I was wrongful charged with running a solid waste facility  without a license!  The charge by the officer was ludicrous! I represented myself in court, I filed MOTIONS, and I showed up ever court date, but the officers failed to show-up in court ever time. That because the charges were bogus and put on me as a harassment to be tax taxing and a financially  draining! Yes once again harassment, false charges at great expense to me and my family. I proved that I was wrongfully accused! Time to post more of that, and newspaper clipping on the internet too!

          In late 2005, my neighbor who is a NY State Trooper, had  2  large German Shepard dogs that were running wild killing farm animals, including my farm chickens an turkeys. I was savagely attacked and bit by one the large German Shepherds, only to learn that the large German Shepard did not have rabies shots!  I had to do rabies shots, and I spent Christmas very sick from the weeks of rabies shots! I should of sue them, but I tried to be a good neighbor and just made them pay for my medical bills! Later I learned that my neighbor "Mike" across  the road, in the small brown house, shot the two dogs some days later, while the wild dogs were killing his child's rabbits and ducks. I thought things could end there, but I was wrong, shortly after Christmas, came the more harassment and problem of 2006!

    With retrospect, what never hit the newspapers was the wrongful 2006 charges against me, all done in court behind closed doors in Canton. Yes I represented myself, before the Honorable Judge Day. With a long list of reputable subpoenaed witnesses. "Judge Eric Gustafson", was subpoenaed as a witness. Many months of hearings and testimony, whereupon thereafter Judge Day verified that I was telling the truth, and in mid 2007 handed down a formal written decision 100% in my favor. As written in the decision by Judge Day, I  proved that the officer lied, and submitted false evidence, and also one County worker was proven to be incompetent. Yes, once again at great expense to me and my family I proved that I was wrongfully accused of serious allegation!

    With retrospect in 2007, remember the big asbestos problems at the MCS elementary schools. This problem, with evidence, was reported by me to the NY State Troopers Office in Massena, who told me that I was imagining it, and that "no asbestos was being removed illegally from the MCS schools or their intelligence department would know about it", and then the  Massena NY State Troopers refused to even look at what I had! We all know what happened next, complaint was pressed unto higher authorities, whereupon thereafter it was proven of  school contaminated, then school closed,  and  then MCS busted for illegal removal of asbestos, with the same pictures/evidence that the NY State troopers refused to look at!   

   Now lets look at these new 2009 charges just placed upon me by a NY State Trooper rookie. I am a  person, with one moving violation in over  38 years, and without even a parking ticket in all those years! Yes, I was wrongfully multi spam-ticketed by a Potsdam Rookie State Trooper from the 2008 New York State Police 195th Basic School Class.   All I can say is that my plea is not guilty, and the current Aug./2009 actions by this rookie NY State Trooper are outrageous raw retaliation against me!   This type of mistreatment by NY State Troopers seems to be very common now across the state of NY,  with logic extrapolation applied, it is a factual result of when you give a unprofessional, and under-trained person, with little to no education in the law,  a badge and a gun, and send that person into the innocent public! What do you expect, giving a person with half an education , unlimited power as if God over the innocent public? Power corrupt and ultimate power destroys! I have been through this before, and I have witnessed others with NY State trooper problems, the sergeants of the rouge State Trooper will do whatever they can to cover-up the officer's wrong doings, in many cases altering the daily blotter/logs, and harsh intimidation on the person trying to make a valid complaint!

              But with a strong legal,  and versed paralegal associates to confer with, I have faith in the law courts.  I plan on presenting  a meticulous immovable  supported defense, in the same manner that Abraham Lincoln would.   I have numerous witnesses on my list, including Judge Crandall (he surely knows why).  I  welcome the news medias, and all good citizens that are willing to attend to watch and learn more about courts, and the color of the law vs. the sprit of the law, as applied per se within the written intent of the laws, by those who wrote the laws.  Please come to this open trial!
